Marceda Starks, Principal of Hardwick Law Firm, LLC, has established her practice in the areas of healthcare, corporate and transaction law.

Ms. Starks is an experienced legal advisor with insightful knowledge of healthcare law.  Her engagements include representing large hospital systems, ambulatory surgery centers, long-term care facilities, county health departments, Federally Qualified Health Centers, hospice, and other healthcare providers in transactional and regulatory compliance matters.  She has drafted and negotiated a variety of health care contracts, including physician employment agreements (inclusive of template agreements to be used broadly across large health system platforms), service agreements, collaborative practice agreements, professional services agreements, recruitment agreements, nursing home agreements and affiliation agreements.  Her expertise allows her to advise clients regarding medical staff issues, including peer review and quality review committees and preparing and revising medical staff bylaws, rules and regulations, and policies and procedures. 

Ms. Starks has a strong history of advising clients on health care governance, Stark Law compliance, HIPAA compliance, and the Anti-Kickback Statute.  She has prepared tax exemption applications for health care organizations and petitions for reconsideration; represented clients before state administrative agencies; and prepared Change of Ownership applications and advised clients on change-of-ownership-related licensure issues.  Additionally, Ms. Starks has been involved in the review and preparation of corporate compliance materials and compliance programs to comply with the Health Insurance Portability and Accountability Act (HIPAA) as well as Guidance from the Office of Inspector General (OIG) for compliance programs. Ms. Starks also provides labor and employment business advise for clients.
