This Privacy Policy and our Disclaimer set forth the conditions under which you may access and use the website.  This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website www.hardwicklaw.com, including any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the “Site”). When you visit our Site and use our services, you trust us with your personal information. We take protecting your Data and your privacy very seriously. We hope you take some time to read this privacy policy carefully. If there are any terms in this privacy policy that you do not agree with, please do not access the Site.

This Privacy Policy applies to all information collected through our Site (www.hardwicklaw.com) and/or any Site-related services.

By accessing and using the website, you agree to be bound by our Privacy Policy and Terms of Use then in effect and by all applicable laws.   If you do not agree with any of the Terms of Use or our Privacy Policy, you should not access or use the website for any purpose.  We reserve the right to terminate or limit your access to the website for any violation of the Terms of Use or our Privacy Policy, or for any other reason, in our sole discretion.

  1. Information We Collect
  • Personal Data: Personally identifiable information (“PII”), such as your name, shipping address, email address, and telephone number, and demographic information, such as your age, gender, hometown, and interests, that you voluntarily give to us when you register with the Site or when you choose to participate in various activities related to the Site, such as online chat and message boards.
    • All PII that you provide to us must be true, complete, and accurate; and because we do not collect and store PII, you must notify us of any changes to PII so that we can ensure that your information is up-to-date.
  • Derivative Data: Information our servers automatically collect when you access, visit, use, or navigate the Site such as your IP address, your browser type, your operating system, your access times, and the pages you have viewed directly before and after accessing the Site. This information is primarily needed to maintain the security and operation of our Site, and for our internal analytics and reporting purposes.
  • Financial Data: We do not collect nor process financial information.

  • Enforce  Terms, Conditions, or Policies: For Business Purposes, Legal Matters, and/or possibly Contractual. We will gather your Data and retain your PII in order to ensure that our terms, conditions, and policies are properly enforced and adhered to.
  • Respond to Legal Requests: For Legal Matters. If we receive a subpoena or other legal request, we may need to inspect the Data we hold to determine how to respond.
  • Use For Other Business Purposes: We may use your Data for other Business Purposes, such as data analysis, identifying usage trends, evaluating the effectiveness of promotional campaigns, and improving our Site, products, services, marketing, and your experience.
  1. Disclosure of Your Information

We only share and disclose your Data in the following situations:

Examples include payment processing, data analysis, email delivery, hosting services, customer service, and marketing efforts. We may allow selected third parties to use tracking technology on the Site, enabling them to collect Data about how you interact with the Site over time. This information may be used to analyze and track Data, determine the popularity of certain content, and better understand online activity. Unless described in this Policy, we do not share, sell, rent, or trade any of your Data with any third party for any promotional or marketing purposes that are unrelated to our business or the services we provide.

  • Affiliates: We may share your Data with members of our firm with the right to know or access and located at any of our offices across the United States, in which case we will require those members to honor this privacy policy. Members include our firm headquarters in Kansas City and any affiliated offices.
  • With Your Consent: We may disclose your Data for any other purpose with your consent, which we will obtain in advance and in writing.
  1. Cookies and Tracking Technologies

When you access the Site, your Data is not collected through the use of cookies or tracking technology. Most browsers are set to accept cookies by default. You can remove or reject cookies but be aware that such action could affect the availability and functionality of the Site. However, they can be rendered ineffective by declining all cookies or by modifying your web browser’s settings to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis.

  1. No Intentional International Data Transfer

We do not intentionally transfer, store, or process your Data in countries other than the United States. Hardwick servers are located in Kansas City, Missouri. If you are accessing our Site from the United States, please be aware that your Data may be transferred to, stored, and processed by us within our facilities and offices in the United States and by third-party vendors with whom we contract for technical or website support (see “Disclosure of Your Data” above). If you are a resident of the European Union or of any other country, please note that we may not have data protection or other laws as comprehensive as those in the European Union or in your country. However, we will take all necessary measures to protect your Data in accordance with this privacy policy and applicable United States law.

Our IT manager is subject to the regulatory enforcement powers of the U.S. FTC and other state and federal regulatory Authorities. In certain situations, we may be required to disclose Data in response to lawful requests by Authorities, including to meet national security or law enforcement compliance and disclosure requirements. We will only disclose Data when a required to comply with the law (see “Compliance with Laws” above for further details).

  1. Jurisdiction and Venue

By accessing our site and providing your data, you agree to submit to the jurisdiction of, and adjudicate any disputes or claims as provided in the Disclaimer.

We will retain your Data only for as long as is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). When we have no ongoing legitimate business need to process your Data, we will either delete or anonymize it, or, if this is not possible (for example, because your Data has been stored in backup archives), then we will securely store your Data and isolate it from any further processing until deletion is possible.

While we have taken reasonable steps to secure the Data you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of electronic or digital data or information transmission can be guaranteed against any interception or other type of misuse.

We do not knowingly solicit information from or market to children under the age of 13. If we learn that we have collected Data from a child under age 13 without verification of parental consent, we will delete that Data as quickly as possible.

If you are a resident of California, you are granted specific rights regarding access to your Data.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about the categories of Data we disclosed to third parties (if any) for direct marketing purposes and the names and addresses of all third parties with which we shared Data in the immediately preceding calendar year (if at all).
